Terms and Conditions
Welcome to Winmore Agencies (www.winmoreagencies.com). This website is brought to you by Winmore Agencies (“Winmore Agencies”, or “we” or “us”) and all rights are controlled and owned by Winmore Agencies.
Please read all terms and conditions before purchasing any products from the website. By making a purchase you agree to be bound by these terms and conditions.
General Conditions
Winmore Agencies is not liable for any injuries or damages incurred whilst using or wearing any accessories, clothing or tools purchased from us. Users are responsible for making sure the correct products are used for the intended application.
Customer Privacy Policy
Winmore Agencies shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Winmore Agencies reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at its discretion. If we cancel an order, it will be without charge to you.
If you are under sixteen (16), you may use the website only with the permission and supervision of a parent or guardian.
Our Contract
When you place an order to purchase a product from the website, we will send you an email confirming receipt and containing order details. Your order represents an offer to us to purchase a product, which is accepted when we send an email to you confirming that we have accepted the order (the ‘order confirmation email’). Such acceptance will be complete when we send the order confirmation email to you. You are seeking to enter into a contract with Winmore Agencies when you place an order.
This contract is legally binding when you have placed an order, your order has been accepted by us and we have sent you the confirmation email.
Winmore Agencies will retain the ownership in the products until full payment has been made by you and has been received by Winmore Agencies .
Winmore Agencies only delivers its products to the locations in South Africa. In the event that an order is placed for a delivery to a location where we do not deliver, the order will be cancelled and a refund processed.
Deliveries
We will endeavour to deliver all products ordered within the time period specified on your order confirmation email.
All products purchased from the website are made pursuant to a shipment contract. This means that the risk of loss for such products passes to you on delivery to the carrier. If you have received your order confirmation email but your products have not arrived within the time specified, please contact us and we will do our best to assist. Please allow an additional day before raising a query during exceptionally busy periods (Black Friday, Easter, Christmas).
Pricing
Items featured on our website may not always be in stock. Prices and specifications subject to change without notice. The price advertised on the holder cover may vary due to different the various options within the holder, therefore the price that is added to your shopping cart is the final price. If you cannot add the item to your cart, it is very likely that stock is not available. You may contact us to confirm. Gift cards and/or Online Vouchers cannot be refunded or redeemed for cash.
Pending Orders:
Stock is only reserved once full payment has been made. Failure to make payment on PENDING orders after 5 days will result in your order being cancelled on our system unless you are an account holder with ourselves and have credit available.
Return and Refunds Policy
Returns
If you are not happy with your products, please follow our delivery, returns, exchanges and repairs policy, so that we can exchange or refund your order. Winmore Agencies reserves the right to reject the return of products that are not returned in accordance with this policy procedure. We may request that you pay delivery charges to return such goods back to you.
SWAP (Exchange)
If you have purchased the incorrect size and want to exchange for a different size, you need to follow the instructions for returns above.
The customer will be responsible for all fees related to courier of products back and forth to Winmore Agencies.
Please note: your right to exchange or return products is separate from your statutory right to cancel your order under the distance selling regulations (see below).
Please note that the cost of couriering the product back to Winmore Agencies shall be incurred by the purchaser.
Statutory right to cancel
South African customers in addition to our returns or exchange procedure, you have seven (7) working days (beginning the day after receipt of the goods) to cancel your purchase order under the distance selling regulations.
These legal rights do not apply to non South African customers.
Conditions for all returns, exchanges or statutory right to cancel
All goods must be returned to us unused, together with all original packaging (please note you have a duty to take reasonable care of returned goods and any refund may be withheld or a charge incurred if you fail to take such care and damage the goods). Please make sure that your return package is packed and sealed securely (in or with the original packaging if possible). Packages must be returned with the freight prepaid.
Please do not return items to uswithoutinstruction detailing where goods need to be sent or your return may be severely delayed.
Discrepancies
If there are any discrepancies with your order, you must notify us as soon as possible. If you have been shipped the incorrect goods then please accept our apologies. Please contact a member of our sales team and we will arrange a collection of these good. Any replacements will be sent at no extra cost.
Refunds
The provision of goods and services by Winmore Agencies is subject to availability. In cases of unavailability, Winmore Agencies will refund the client in full within 7-15 days. Cancellation of orders by the client will attract a handling fee and administration fee.
Refunds on Returned Products
Once the item has been received we will inspect it and notify you that we have received your returned item.
If your return is approved we will initiate a refund via EFT payment within a certain amount of days depending on your banks policies or a credit to your account.
Shipping Return Costs
You will be responsible for paying for your own shipping costs for returning the item.
Shipping costs are non-refundable.
If you receive a refund the cost of shipping will be deducted from your refund.
All prices quoted are subject to:
- Availability of stock.
- Final confirmation at time of placing order.
Pricing and Availability
All prices are quoted in Rand and are exclusive of VAT unless otherwise specified. All item prices are exclusive of delivery charges. We list availability information for products sold on the website, including on each product information page. We cannot be more specific about availability than what is stated on the site. Dates are not guaranteed and should not be relied upon. As we process your order, we will inform you by email if any products are subsequently found to be unavailable.
Despite our best efforts, a small number of the products on the website may be mis-priced. If a product’s correct price is lower than our stated price, we will charge the lower amount and send you the product. If a product’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping the products or cancel your order and notify you of such cancellation. There may on occasion be an instance of a product image showing the product with an optional extra accessory i.e pants with a jacket, pants with shoes etc. this does not mean that all the items are included in the price when purchasing unless the description specifically mentions that it is included. Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change, update information, or cancel orders where applicable
Events Beyond our Reasonable Control
Winmore Agencies will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights
Delivery Policy
Subject to availability and receipt of payment, requests will be processed within 2-3 working days.
Payment Options Accepted
Payment may be made via Visa, Master Card cards or by bank transfer into the Winmore Agencies bank account, the details of which will be provided on request. Account holders can also purchase using their account with Winmore Agencies provided there is sufficient credit available.
Credit Card Acquiring and Security
Credit card transactions will be acquired for Winmore Agencies by Payfast and are subject to the terms and conditions as laid out by Payfast.
Customer Details Separate from Card Details
Customer details will be stored by Winmore Agencies separately from card details which are entered by the client on the payfast secure site.
Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).
Third Party Providers
In general, third-party providers used by Winmore Agencies, will only collect, use and disclose your information to the extent necessary for the successful completion of any matter relating to services provided. Certain third-party service providers, such as payment gateways and other payment transaction processors, may have their own privacy policies applying to online services. We recommend that you familiarize yourself with these privacy policies, where applicable.
